MAY 2, 2020 DIRECTOR ELECTION POSTPONED TO NOVEMBER 3, 2020

 

On March 18, 2020, in response to the COVID-19 virus, Governor Abbott issued a Proclamation (the “Proclamation”) suspending Sections 41.0052(a) and (b) of the Texas Elections Code and Section 49.103 of the Texas Water Code to the extent necessary to allow political subdivisions that would otherwise hold elections on May 2, 2020, to move their general and special elections for 2020 only to the next uniform election date, occurring on November 3, 2020, without otherwise adjusting the term of office, and suspending Sections 31.093 and 42.0621(c) of the Texas Election Code to the extent necessary to require all county election officers, if requested by an affected political subdivision who postponed their election to November 3, 2020, under the authority of the proclamation; and

 

On March 18, 2020, in response to the Proclamation and pursuant to Texas Election Code 31.003 and 31.004, the Texas Secretary of State issued Election Advisory No. 2020-12 providing guidelines to local political subdivisions that choose to exercise the authority granted by the Proclamation and postpone their election to the November uniform election date (the “Election Advisory”);

 

On April 2, 2020 the Board of Directors met in a Special Session and formally adopted Order No. 2020-0402A Postponing the May 2, 2020 General Election.

Trophy Club Municipal Utility District No. 1 has notified Denton and Tarrant County Election Administrators that it will hold an election on November 3, 2020.  The election will be for the purpose of voting on (2) Directors.

 

Trophy Club Municipal Utility District No. 1 is governed by a Board consisting of five directors elected by Place from the District at large. The District will now be conducting a General Election on November 3, 2020, for two director positions, Director Place 1 and Director Place 2. The persons elected to these positions have terms ending in May of 2024.

DIRECTOR QUALIFICATIONS:

To be qualified to serve as a Director, a person shall be at least 18 years old, a resident citizen of the State of Texas, and either own land subject to taxation in the District or be a qualified voter within the District. (Tex. Water Code Sec. 54.102)

APPLICATION FOR A PLACE ON THE BALLOT:

A person wanting to have their name on the ballot must submit an application for a place on the ballot to Trophy Club Municipal Utility District No. 1 at the address listed above before the end of the filing period. An Application for a Place on the Ballot can be downloaded HERE.

House Bill 305 Election Disclosure:

The following information related to the District’s elections for members of the Board of Directors is being posted by the District pursuant to Section 2051.152 of the Texas Government Code (enacted by House Bill 305 during the 2019 Texas Legislative Session):
1. The date and location of the next election for members of the Board of Directors of the District:

Elections for directors of the District are conducted on the May uniform election date in even-numbered years. Accordingly, the next election for members of the Board of Directors of the District shall be conducted on the first Saturday in May 2020, which is May 2, 2020.

The election shall be conducted at the polling places established by Tarrant County and Denton County to serve the counties’ regular election precincts within the District, as required by Sections 42.0621 and 43.004 of the Texas Election Code.

2. The requirements and deadline for filing for candidacy of each elected office of the District:

In order to be qualified to serve as a director of a municipal utility district, Section 54.102 of the Texas Water Code requires that a person be at least 18 years old, a resident citizen of the State of Texas, and either own land subject to taxation in the district or be a qualified voter within the district.

A person that desires to be a candidate for the director election must timely complete and submit an application for a place on the ballot for the election. Applications for a place on the ballot may be obtained from the District’s Administrative Office located at 100 Municipal Drive, Trophy Club, Texas 76262, or may be downloaded and printed out from the

Secretary of State’s website: (https://www.sos.state.tx.us/elections/forms/index.shtml) or by clicking HERE.

The deadline for filing the application for a place on the ballot is 78 days prior to the election. For the May 2, 2020 director election, the deadline for filing the application for a place on the ballot will be Friday, February 14, 2020. The deadline for write-in candidates is 74 days before the election. For the May 2, 2020 director election, the deadline for write-in candidates is Tuesday, February 18, 2020.
